In signing this release, I acknowledge that I understand its intent, and for myself, my heirs, executors, administrators and representatives, do hereby agree and absolve and hold harmless the National Multiple Sclerosis Society, Pacific South Coast Chapter, the City of Carlsbad, City of Encinitas, the Westfield Group, City of San Clemente, County of San Diego, San Elijo Hills Development Company,LLC, HomeFed Corp., corporate sponsors, cooperating organizations and any other parties connected with this event in any way together with their respective successor and assigns (the “Sponsors”), singly and collectively, from and against any blame and liability for any injury, harm, loss, inconvenience, or any other damage of any kind whatsoever,including but not limited to damage or loss to bicycle and/or accessories, which may result from or be connected in any way to my participation in the 2009 Bike MS Bay to Bay Tour ("Event"). In addition to the absolute and unqualified release from all liability, I hereby represent that I am physically capable of participating in this event, that my bicycle and any other equipment I may use to participate in the event is in working condition, that I will observe all applicable traffic and event rules and that I will wear a helmet and generally conduct myself in a safe and prudent manner while participating in the event and I hereby absolve and hold harmless the Sponsors from any damage I may sustain because of any breach of these representations. I hereby consent to and permit emergency treatment in the event of injury or illness while participating in this event. I also give permission to the National Multiple Sclerosis Society, Pacific South Coast Chapter, to release my name, addresses and phone numbers to any official representative of a team which I have chosen to join. I also hereby give permission to the National MS Society, Pacific South Coast Chapter to use my name or image by way of a photograph, video or audio format taken of me during the event in any promotional materials, publications or any other electronic media in addition to disclosing my name on the Chapter’s Web site, which includes online pledging. I understand that I am responsible to pay a minimum of $400 through pledges or a personal donation by the time I check-in. All riders must meet the $400 fundraising minimum before participating in the Tour. Please note, registration, bus transportation and parking fees are non-refundable and non-transferrable. Notice: The wavier for riders under the age of eighteen (18) but at least 12 year of age must be notarized and returned to the Chapter prior to check-in. The rider must also be accompanied by an adult (21 or older) at all times even if they leave the route.
